    1. on which the Privileged Buyer, or a third party other than the carrier indicated by the Privileged Buyer, acquired physical possession of the goods;
    2. on which the Privileged Buyer, or a third party other than the carrier indicated by the Privileged Buyer, acquired physical possession of the last good, lot or piece, in the case of a contract for multiple goods delivered separately, in lots or in pieces.
  3. To exercise the right of withdrawal, the Privileged Buyer must inform the Seller, using the details given in § 2 of the Terms, of their decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or email).
  4. The Privileged Buyer may use the model withdrawal form included at the end of the Terms, but this is not obligatory.
  5. To meet the withdrawal deadline, it is sufficient for the Privileged Buyer to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

    EFFECTS OF WITHDRAWAL
  6. If the contract is withdrawn from, the Seller will reimburse the Privileged Buyer all payments received from them, including the costs of delivery (with the exception of additional costs resulting from the Privileged Buyer's choice of a type of delivery other than the least expensive type of standard delivery offered by the Seller), without undue delay and in any event not later than 14 days from the day on which the Seller is informed of the Privileged Buyer's decision to withdraw from the contract.
  7. The Seller will carry out the reimbursement using the same means of payment as the Privileged Buyer used for the initial transaction, unless the Privileged Buyer has expressly agreed otherwise; in any event, the Privileged Buyer will not incur any fees as a result of such reimbursement.
  8. If the Seller has not offered to collect the goods from the Privileged Buyer, the Seller may withhold the reimbursement until it has received the goods back or until the Privileged Buyer has supplied evidence of having sent back the goods, whichever is the earliest.
  9. The Seller asks that the goods be returned to: ul. Polki 1A/10, 02-826 Warszawa, Poland, without undue delay and in any event not later than 14 days from the day on which the Privileged Buyer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Privileged Buyer sends back the goods before the period of 14 days has expired.
  10. The Privileged Buyer bears the direct cost of returning the goods.
  11. The Privileged Buyer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
  12. If, due to their nature, the goods cannot normally be returned by post, the Privileged Buyer will also bear the direct cost of returning the goods. The Privileged Buyer will be informed by the Seller of the estimated amount of these costs in the product description in the Store or when placing the order.

    2. for the supply of goods which are liable to deteriorate or expire rapidly;
    3. for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
    4. for the supply of goods which, after delivery, are, according to their nature, inseparably mixed with other items;
    5. for the supply of sealed audio or video recordings or computer software which were unsealed after delivery;
    6. for the supply of a newspaper, periodical or magazine, with the exception of subscription contracts;
    7. for the supply of goods or services for which the price is dependent on fluctuations in the financial market which cannot be controlled by the Seller and which may occur within the withdrawal period.

§ 9 COMPLAINTS

I GENERAL PROVISIONS

  1. The Seller is liable to the Privileged Buyer for the conformity of performance with the contract, as provided for by generally applicable law, in particular the Consumer Rights Act.
  2. The Seller asks that complaints (including those concerning the operation of the Store) be submitted to the postal or email address given in § 2 of the Terms.
  3. If a guarantee has been granted for a product, information about it and its terms is available in the Store.
  4. The Seller will respond to a complaint within 14 days of receiving it.

II PRIVILEGED BUYERS

  1. Goods
    1. If the goods do not conform with the contract, the Privileged Buyer may exercise the rights set out in Chapter 5a of the Consumer Rights Act.
    2. The Seller is liable for any lack of conformity of the goods with the contract which exists at the time of delivery and becomes apparent within two years from that time, unless the shelf life of the goods specified by the Seller, its legal predecessors or persons acting on their behalf is longer.
    3. Under the Consumer Rights Act, in the event of a lack of conformity with the contract, the Privileged Buyer may demand:
      1. replacement of the goods,
      2. repair of the goods.
    4. In addition, the Privileged Buyer may submit a statement on:
      1. a price reduction,
      2. withdrawal from the contract
      where:
      • the Seller has refused to bring the goods into conformity with the contract in accordance with Art. 43d(2) of the Consumer Rights Act;
      • the Seller has not brought the goods into conformity with the contract in accordance with Art. 43d(4)-(6) of the Consumer Rights Act;
      • the lack of conformity persists even though the Seller has tried to bring the goods into conformity with the contract;
      • the lack of conformity is so significant that it justifies a price reduction or withdrawal from the contract without first using the remedies set out in Art. 43d of the Consumer Rights Act;
      • it is clear from the Seller's statement or the circumstances that the Seller will not bring the goods into conformity with the contract within a reasonable time or without undue inconvenience to the Privileged Buyer.
    5. Where goods are to be repaired or replaced, the Privileged Buyer should make them available to the Seller. The Seller collects the goods from the Privileged Buyer at its own expense.
    6. The Privileged Buyer may not withdraw from the contract if the lack of conformity of the goods is minor.
    7. In the event of withdrawal from the contract referred to in this section (concerning goods), the Privileged Buyer will return the goods to the Seller without undue delay, at the Seller's expense, to ul. Polki 1A/10, 02-826 Warszawa, Poland. The Seller will refund the price to the Privileged Buyer without undue delay, no later than 14 days from receiving the goods or proof of their return.
    8. The Seller will refund to the Privileged Buyer the amounts due as a result of a price reduction without undue delay, no later than 14 days from receiving the Privileged Buyer's price reduction statement.
  2. Out-of-court complaint and redress procedures
    1. The Seller informs the Consumer of the possibility of using out-of-court complaint and redress procedures. The rules for accessing these procedures are available at the offices or on the websites of the bodies authorised to resolve disputes out of court.

      The Consumer may, among other things, seek help from the relevant European Consumer Centre within the European Consumer Centres Network. The Centres provide information on consumer rights and help resolve disputes concerning cross-border purchases. Help from the European Consumer Centres is generally free of charge. The list of Consumer Centres for each country is available at: https://konsument.gov.pl/eck-w-europie/

      In addition, in the Republic of Poland the following forms of support are available:
      • mediation conducted by the competent Provincial Trade Inspectorate (Wojewódzki Inspektorat Inspekcji Handlowej), to which a request for mediation should be submitted. The procedure is generally free of charge. The list of inspectorates is available here: https://uokik.gov.pl/kontakt-inspekcja-handlowa
      • assistance of the competent permanent consumer arbitration court operating at the Provincial Trade Inspectorate, to which a request for the case to be heard by the arbitration court should be submitted. The procedure is generally free of charge. The list of inspectorates is available at: https://uokik.gov.pl/kontakt-inspekcja-handlowa
    2. The above provision is for information purposes only and does not oblige the Seller to use out-of-court dispute resolution procedures.
    3. Using out-of-court complaint and redress procedures is voluntary for both the Seller and the Consumer.
    4. The Consumer may also seek free assistance from the municipal or district consumer ombudsman.

III BUYERS OTHER THAN PRIVILEGED BUYERS

  1. For the avoidance of doubt, the Seller points out that § 11(7) applies to the Seller's complaint-related liability towards a Buyer other than a Privileged Buyer.

§ 10 PERSONAL DATA

  1. The controller of the personal data provided by the Buyer when using the Store is the Seller. Detailed information on the processing of personal data by the Seller - including other purposes and legal bases of processing and data recipients - can be found in the privacy policy available in the Store, in line with the principle of transparency set out in the General Data Protection Regulation of the European Parliament and of the Council (EU) - “GDPR”.
  2. The purpose of processing the Buyer's data provided in connection with purchases in the Store is order fulfilment. The legal basis for processing personal data in this case is:
    • a contract or steps taken at the Buyer's request prior to entering into it (Art. 6(1)(b) GDPR),
    • the Seller's legal obligation, in particular relating to accounting and product safety (Art. 6(1)(c) GDPR), and
    • the Seller's legitimate interest in processing data in order to establish, pursue or defend possible claims (Art. 6(1)(f) GDPR).
  3. Providing data is voluntary but necessary to conclude the contract. Failure to provide data will prevent the conclusion of a contract in the Store.
  4. The Buyer's data provided in connection with purchases in the Store will be processed until:
    1. the contract between the Buyer and the Seller ceases to be in force;
    2. the Seller is no longer subject to a legal obligation requiring it to process the Buyer's data;
    3. the possibility of pursuing claims by the Buyer or the Seller in connection with the contract concluded through the Store expires;
    4. the Buyer's objection to the processing of their personal data is accepted - where the processing was based on the Seller's legitimate interest
    - whichever applies in the given case.
  5. The Buyer has the right to request:
    1. access to their personal data,
    2. rectification of their data,
    3. erasure of their data,
    4. restriction of processing,
    5. transfer of their data to another controller
      as well as the right to:
    6. object at any time, on grounds relating to the Buyer's particular situation, to the processing of their personal data based on Art. 6(1)(f) GDPR (i.e. on the Seller's legitimate interests).
  6. To exercise their rights, the Buyer should contact the Seller using the details given in § 2 of the Terms.
  7. If the Buyer believes that their data is processed unlawfully, the Buyer may lodge a complaint with the competent data protection authority. In Poland, this is the President of the Personal Data Protection Office (Prezes UODO).

§ 11 RESERVATIONS

  1. The Buyer is prohibited from providing unlawful content.
  2. Each order placed in the Store constitutes a separate contract and requires separate acceptance of the Terms. The contract is concluded for the time and purpose of fulfilling the order.
  3. All contracts concluded under these Terms are governed by Polish law, subject to section 4.
  4. The choice of Polish law for contracts concluded with a Consumer under the Terms does not exclude or limit the rights of that Buyer under the mandatory provisions of law that would apply to the Consumer in the absence of a choice of law. In particular, this means that if the national provisions applicable to a given Consumer provide broader protection than these Terms or Polish law, that broader protection applies.
  5. Contracts under the Terms are concluded in Polish.
  6. In the event of a dispute with a Buyer who is not a Privileged Buyer relating to a contract concluded through the Store, the court competent for the Seller's registered office will have jurisdiction.
  7. Any liability of the Seller towards a Buyer who is not a Privileged Buyer under a contract concluded through the Store is excluded to the extent permitted by law.
  8. The Website Terms of Use, available in the Store, apply to the use of the Store website and the features available on it.
